Ratio Decidendi

The court found that while the trial court lawfully exercised its discretion in imposing a custodial sentence above the statutory minimum due to the aggravating circumstances (the large quantity of elephant tusks), it failed to consider the period the Applicant spent in remand custody as required by Section 333(2) of the Criminal Procedure Code. Taking this period into account, and considering remission, the court held that the Applicant had served his sentence and was entitled to immediate release.
