Ratio Decidendi

The court found that although the plaintiff had purchased the land and paid the full amount, the land was held jointly by the defendant and Benson Toy Mmbulika, who was not a party to the proceedings and whose consent to the transfer had not been obtained. Section 91(6) of the Land Registration Act prohibits a tenant in common from transferring their undivided share without the written consent of the other co-owners. As such, the plaintiff could not be registered as owner of the land without the requisite consent, and the court could not compel the defendant to effect the transfer in the absence of such consent. The suit was therefore dismissed.
