Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the conviction for defilement was supported by the evidence on record.
  2. 2 Whether the sentence imposed by the trial court was lawful under the Sexual Offences Act.

Ratio Decidendi

The High Court found that the evidence on record, including the complainant's clear and graphic testimony, corroborating witness accounts, and medical evidence confirming penetration and injury, proved the offence of defilement beyond reasonable doubt. The trial magistrate's finding of guilt was upheld. However, the sentence of twenty years' imprisonment was unlawful because Section 8(2) of the Sexual Offences Act prescribes a mandatory life sentence for defilement of a child aged eleven years or less. The High Court therefore substituted the sentence with life imprisonment and dismissed the appeal in its entirety.

Court Disposition

appeal dismissed; sentence enhanced to life imprisonment

Orders

  • The sentence of twenty years' imprisonment is set aside and substituted with a sentence of life imprisonment.
  • The appeal is dismissed in its entirety.
