The trial magistrate erred by failing to specify the particular points of emphasis justifying the award of Kshs. 350,000 for general damages and by not adequately relating the injuries and comparable authorities to the compensation awarded. The appellate court found the award excessive, considered inflation and comparable cases, and determined that Kshs. 200,000 for general damages and Kshs. 3,000 for special damages, less 15% contributory negligence, was reasonable. The court set aside the lower court's award and substituted it with a net total of Kshs. 172,550 in favor of the respondent, with interest and costs as specified.
