  1. 1 Whether the claimant is entitled to unpaid overtime and off days for the period in question.
  2. 2 Whether the payment of Kshs.51,216 constituted full and final settlement of the claimant's claims.
  3. 3 Whether the claimant discharged the burden of proof for the reliefs sought.

Ratio Decidendi

The court found that the claimant's pleadings and evidence were inconsistent regarding the period for which the claim was made. The claimant admitted under oath that he had been paid all dues for the period from 2005 onwards and had no further claim for that period. The court accepted the respondent's evidence that the sum of Kshs.51,216 was paid as full and final settlement for the period in dispute. The court held that the claimant failed to discharge the burden of proof on a balance of probability for the reliefs sought, as his claim was not supported by evidence for the period pleaded. Consequently, the suit was dismissed.
