Procedural Posture

Succession Cause / Ruling on Validity of Petition and Jurisdiction

  1. 1 Whether a magistrate's court has jurisdiction to entertain a succession cause where the estate value exceeds Kshs. 100,000.
  2. 2 Whether a succession cause filed in a court without jurisdiction can be transferred to the High Court and validated.
  3. 3 Whether the petition and subsequent proceedings are nullities due to lack of jurisdiction.

Ratio Decidendi

The court held that the magistrate's court lacked jurisdiction to entertain the succession cause as the value of the estate exceeded Kshs. 100,000, contrary to Section 48 of the Law of Succession Act. A petition filed in a court without jurisdiction is a nullity ab initio and cannot be validated by transfer to a court of competent jurisdiction. Consequently, the original petition, as well as all subsequent proceedings and purported transfers to the High Court, were nullities. There being no valid petition before the court, the summons for grant of letters of administration was also declared a nullity.

Court Disposition

Petition and all subsequent proceedings declared nullities for want of jurisdiction.

Orders

  • The summons dated 13th March 2012 is declared a nullity.
  • There is no valid petition before the court.
