Ratio Decidendi

The court held that the magistrate's court lacked jurisdiction to entertain the succession cause as the value of the estate exceeded the statutory limit of Kshs. 100,000 under Section 48 of the Law of Succession Act. As a result, the initial petition was a nullity ab initio. The purported transfer of the cause to the High Court could not cure the defect, as there was no valid suit to transfer. Consequently, all subsequent proceedings, including the registration of the cause in the High Court and the summons for grant of letters of administration, were also nullities. The court declared that there was no valid petition before it and dismissed the summons accordingly.
