Civil Application / Ruling on Application to Deem Notice of Appeal Withdrawn

  1. 1 Whether the respondent's notice of appeal should be deemed as withdrawn for failure to institute an appeal within the prescribed time.
  2. 2 Whether the applicant is entitled to costs upon withdrawal of the notice of appeal.

Ratio Decidendi

The Court found that the respondent failed to institute an appeal within the prescribed time after lodging the notice of appeal, and its application for extension of time to file and serve the memorandum and record of appeal had been dismissed. Consequently, under Rule 85(1) of the Court of Appeal Rules, 2022, the notice of appeal was deemed withdrawn. The Court held that the notice of appeal was procedurally valueless and that the applicant was entitled to costs as provided by Rule 85(2). The Court thus ordered that the respondent's notice of appeal be deemed withdrawn with costs to the applicant.

Court Disposition

Application allowed. Notice of appeal deemed withdrawn with costs to the applicant.

Orders

  • The respondent's notice of appeal dated 5th October 2021 and lodged on October 7, 2021 is deemed as withdrawn pursuant to rule 85(1) of the Court of Appeal Rules, 2022.
  • Costs of the application awarded to the applicant.
