Ratio Decidendi

The respondent failed to institute an appeal within the prescribed time after lodging the notice of appeal and its application for extension of time was dismissed. Under Rule 85(1) of the Court of Appeal Rules, 2022, such failure results in the notice of appeal being deemed withdrawn. The respondent's notice of appeal thus lost any procedural value and was liable to be deemed as withdrawn. The applicant, having been served with the notice, is entitled to costs as provided by Rule 85(2). The court accordingly deemed the notice of appeal as withdrawn and awarded costs to the applicant.
