The court found that the applicable law was the repealed Employment Act (Cap 226), not the Employment Act, 2007, as the termination occurred before the latter came into force. Under the repealed law, the employer was entitled to terminate the contract by giving notice or payment in lieu, without the procedural requirements of the new Act. The Claimant's summary dismissal was therefore converted to a normal termination, entitling him to one month's salary in lieu of notice.
