The Court of Appeal lacks jurisdiction to entertain an application for leave to file an appeal out of time in succession matters unless the applicant has first obtained leave to appeal from the High Court or, if refused, from the Court of Appeal. Section 47 of the Law of Succession Act does not confer an automatic right of appeal to the Court of Appeal from decisions of the High Court in its original jurisdiction. The applicant did not first seek or obtain leave to appeal, rendering the present application premature.
