The court held that the issue of jurisdiction is paramount and must be determined before considering the merits of the application for injunctive relief. Given that the amount in dispute falls within the pecuniary jurisdiction of the Chief Magistrate's Court (up to Kshs 20 million), and in line with Sections 11 and 18 of the Civil Procedure Act and relevant practice directions, the High Court found it inappropriate to proceed with substantive orders. The court therefore declined to grant the injunctive relief sought and instead ordered the transfer of the suit to the subordinate court at Milimani, Nairobi, which is competent to hear and determine the matter.
