Ratio Decidendi

The court found that the claimant was declared redundant and not a voluntary resignant, and that the respondent failed to follow due procedure under Section 40(1) of the Employment Act by not giving the requisite notice to the claimant. The redundancy was therefore procedurally unfair. The court also found that the claimant's claim for medical reimbursement beyond the policy ceiling was unsupported by evidence, as the applicable policy limited reimbursement to Kshs.100,000 per annum. The claimant was awarded one month's salary in lieu of notice and twelve months' salary as compensation for unfair redundancy. The respondent was ordered to pay the costs of the case.
