Procedural Posture

Civil Suit / Ruling on Application for Dismissal for Want of Prosecution

  1. 1 Whether the suit should be dismissed for want of prosecution due to the plaintiffs' delay in taking steps for over four years.
  2. 2 Whether the defendant has demonstrated prejudice or impossibility of a fair trial due to the delay.
  3. 3 Whether the plaintiffs have provided sufficient cause for the delay in prosecuting the suit.

Ratio Decidendi

The court found that although the plaintiffs had delayed prosecution for over four years, the defendant had not demonstrated any prejudice suffered as a result of the delay, nor had it been shown that a fair trial was no longer possible. The plaintiffs had now filed witness statements and expressed readiness to proceed. The court held that, in the interests of justice, the plaintiffs should be given a final opportunity to prosecute their case, provided they take discernable steps within 30 days to move the matter forward. The application for dismissal was therefore dismissed, but the plaintiffs were ordered to pay the costs of the application to the defendant.

Court Disposition

application dismissed; suit to proceed

Orders

  • Plaintiffs to take discernable steps within 30 days to move the case towards hearing.
  • Plaintiffs to take a date for pre-trial directions within 30 days.
