Criminal Appeal / Ruling on Bail Pending Appeal and Application for Discharge

  1. 1 Whether the appellant should be discharged in Meru Criminal Case No. 1410 of 2018 on grounds of double jeopardy.
  2. 2 Whether the appellant should be granted bail/bond pending the hearing and determination of this appeal.

Ratio Decidendi

The court found that the charges in Meru Criminal Case No. 1327 of 2018 and Meru Criminal Case No. 1410 of 2018, though arising from the same transaction, are different in law and fact, involving different offences and amounts. Therefore, the claim of double jeopardy does not arise at this stage, and the issue should be raised before the trial court. Regarding bail pending appeal, the court applied the principles from Dominic Karanja v. Republic and Jivraj Shah v. Republic, noting that the sentence is six months and there is a possibility that a substantial part of it will have been served before the appeal is heard. On this basis, the court granted the appellant bail or bond pending appeal.

Court Disposition

Application for discharge on double jeopardy dismissed; bail pending appeal granted.
