The court found that the prosecution failed to prove beyond reasonable doubt that the appellant was the perpetrator of the offence. The identification evidence was not free from error, as the circumstances under which the appellant was identified at night were not adequately established. The court noted that except for one witness who mentioned moonlight, there was no sufficient evidence regarding the nature and quality of light that enabled identification. The court concluded that the danger of mistaken identification was great and that the conviction was unsafe. Consequently, the conviction was quashed and the sentence set aside.
