Ratio Decidendi

The court found that although the application was brought under a provision dealing with stay of execution, the substance of the application was for a stay of proceedings pending appeal. The court accepted the applicant's evidence, including affidavits and counsel's statements, that a stay order had previously been granted in the lower court before the file went missing. The respondent did not deny that a consent order for stay had been recorded. Given the missing file and the need to preserve the integrity of the appeal, the court concluded that a stay of proceedings was warranted to prevent the appeal from being rendered nugatory. The application was therefore granted as prayed.
