Ratio Decidendi

The court found that the applicant was unable to raise bond and remained in custody from 15th August 2011, the date of arraignment. The court held that, pursuant to Section 333(2) of the Criminal Procedure Code, the applicant is entitled to have the period spent in remand custody factored into his sentence. Accordingly, the sentences of 20 years on Counts I and II and 2 years on Count III, all to run concurrently, are to be computed from 15th August 2011, the date the applicant was first remanded in custody.
