Legal Issues
- 1 Whether the identification evidence against the appellants was sufficient to sustain a conviction for robbery with violence.
- 2 Whether the convictions for assault could be substituted in the absence of reliable identification evidence.
- 3 Whether the prosecution discharged its burden of proof beyond reasonable doubt.
Ratio Decidendi
The court found that the identification evidence against all appellants was unreliable and insufficient to sustain convictions for robbery with violence or assault. The complainants did not know the appellants prior to the incident, and no identification parade was conducted. Dock identification alone was deemed worthless. The evidence of the only other witness, PW 4, was inconsistent and could not be relied upon. As a result, the prosecution failed to discharge its burden of proof beyond reasonable doubt. The court allowed the appeals in their entirety, quashed the convictions, set aside the sentences, and ordered the immediate release of the appellants unless otherwise lawfully held.
Court Disposition
appeal allowed; convictions quashed; sentences set aside; appellants to be released unless otherwise lawfully held.
Orders
- The appeals of all appellants are allowed in their entirety.
- The convictions of all appellants are quashed.
