Ratio Decidendi

The court found that the identification evidence against all appellants was unreliable and insufficient to sustain convictions for robbery with violence or assault. The complainants did not know the appellants prior to the incident, and no identification parade was conducted. Dock identification alone was deemed worthless. The evidence of the only other witness, PW 4, was inconsistent and could not be relied upon. As a result, the prosecution failed to discharge its burden of proof beyond reasonable doubt. The court allowed the appeals in their entirety, quashed the convictions, set aside the sentences, and ordered the immediate release of the appellants unless otherwise lawfully held.
