- 1 Whether the claimant should be granted an opportunity to prosecute his case despite the respondent's application.
- 2 Whether the respondent is entitled to costs of the application.
Ratio Decidendi
The court exercised its discretion in favour of the claimant, finding that he should be given an opportunity to prosecute his case. The respondent's application was not granted, but the respondent was awarded costs of the application. The decision was guided by the principle that justice is best served by allowing parties to be heard on the merits, unless there are compelling reasons to deny such an opportunity. The court balanced the interests of both parties by granting the claimant leave to proceed while compensating the respondent with costs for the unsuccessful application.
Court Disposition
Application dismissed; claimant granted opportunity to prosecute case; respondent awarded costs of the application.
Orders
- The claimant is granted a chance to prosecute his case.
- The respondent is awarded costs of the application.
