The Court of Appeal held that the essential elements of the offence of trafficking in narcotic drugs were proved beyond reasonable doubt, notwithstanding the discrepancy in the weight of the drugs. The court found that the seizure notice was properly issued in accordance with a purposive interpretation of the relevant statutory provisions, and that the procedural lapses did not prejudice the appellant. However, the fine imposed was based on an incorrect weight and was therefore unlawful. The court recalculated the fine based on the proven weight of 1,659.0 grammes at Kshs. 1,000 per gramme, multiplied by three, resulting in a lawful fine of Kshs. 4,977,000.
