The High Court's role under section 28 of the Arbitration Act is to provide assistance in taking evidence for arbitral proceedings when requested and approved by the arbitral tribunal. The court does not review the relevance of the evidence, as that is for the tribunal to determine. The consultants, as independent contractors, are compellable witnesses unless a statutory exemption applies, and the confidentiality clause in their contract does not automatically bar their testimony since CBK did not demonstrate that the evidence sought was protected by confidentiality. There was no showing that compelling their testimony would contravene public policy, statute, or the constitution....
