Procedural Posture

Stay Application / Ruling on Application for Stay of Execution and Proceedings Pending Appeal

  1. 1 Whether the orders and directions issued by the High Court on 31st March 2023 were capable of being stayed pending appeal.
  2. 2 Whether the applicant had demonstrated an arguable appeal to warrant the grant of stay of execution and stay of proceedings.
  3. 3 Whether the application and intended appeal were premature given that substantive issues had not been determined by the High Court.

Ratio Decidendi

The Court of Appeal found that the orders and directions issued by the High Court on 31st March 2023 were purely procedural and did not touch on the substantive issues in contention. The orders were pretrial directions intended to facilitate the hearing and determination of the consolidated petitions and did not constitute a substantive decision capable of being challenged on appeal. The applicant's motion for stay was therefore premature, as no arguable appeal existed at this stage. The court emphasized that it would not engage in premature adjudication or academic discourse, and that the applicant had not satisfied the first limb of the twin principles required for the grant of stay...
