Ratio Decidendi

The court found that the Respondent deserted the Petitioner in November 2007 and has not returned or resumed cohabitation since. The Petitioner filed for divorce in January 2016, nearly seven years after the desertion. The evidence was uncontroverted, as the Respondent failed to appear or contest the proceedings. The court was satisfied that the statutory requirement of desertion for at least three years had been met and that the marriage had irretrievably broken down. Accordingly, the court granted the decree of divorce and ordered the dissolution of the marriage solemnised at the Registrar’s Office in Mombasa on 30th July 2004.
