Ratio Decidendi

The court found that the Petitioner had established, on a balance of probabilities, that the Respondent had treated him with cruelty and that the marriage had irretrievably broken down. The Respondent failed to contest the Petition or appear in court, and the evidence of prolonged separation and lack of cohabitation since 2003 further supported the Petitioner’s case. The court was satisfied that the marriage had no hope of being salvaged and that the legal requirements for dissolution had been met. Accordingly, the court granted a decree nisi dissolving the marriage, to be made absolute after thirty days.
