Ratio Decidendi

The court held that a Notice of Motion is not a prescribed method for commencing a civil suit under Kenyan law. The Civil Procedure Act and Rules require that a suit be instituted by plaint, petition, or originating summons. Since the applicant sought substantive orders through a Notice of Motion without a substantive suit, there was no proper suit before the court. The preliminary objection raised by the respondents was therefore merited. The court struck out the applicant's Notice of Motion and vacated all consequential orders, awarding costs to the 1st to 3rd respondents.
