Ratio Decidendi

The court found that appeals from execution proceedings under Order 22 of the Civil Procedure Rules do not generally lie as of right except for certain specified orders. In this case, the applicant's intended appeal did not fall within those exceptions, and therefore leave of court was required. The application for leave was filed promptly, only five days after the ruling, and the absence of the applicant's advocate at the time of delivery, despite being notified, did not render the application incompetent. The court exercised its discretion to grant leave, finding the application properly before it and not an abuse of process.
