Ratio Decidendi

The court found that the dispute between the parties was fundamentally a boundary dispute concerning the position and measurement of land parcels Kisumu/Kochieng/2902 and Kisumu/Kochieng/2885. The pleadings did not disclose any challenge to the Plaintiff's proprietary rights over his parcel, nor did they establish a valid claim over the Defendants' parcel. The court held that, pursuant to Section 18(2) of the Land Registration Act, it lacked jurisdiction to entertain the suit until the Land Registrar had determined the boundary. The suit was therefore prematurely before the court and had to be struck out for want of jurisdiction.
