Ratio Decidendi

The Claimant failed to prove that her employment was unfairly terminated, as she did not provide evidence or witnesses to support her claim. However, the Respondent, as the employer, failed to discharge the statutory duty to keep and produce employment records, particularly regarding notice and leave. In the absence of such records, the court found the Claimant entitled to one month's salary in lieu of notice and payment for accrued leave, calculated at 1.75 days per month for the period worked. Claims for compensation for unfair termination, rest days, public holidays, general damages, and terminal dues were dismissed due to lack of evidence. Each party was ordered to bear its own costs.
