The High Court found that the trial magistrate erred in adopting a multiplicand of Kshs. 10,000/= per month for loss of dependency without sufficient proof of the deceased's earnings, as the respondent's evidence was uncertain and there was no agreement between the parties. The court held that, in the absence of documentary or reliable oral evidence of income, the multiplier approach was inappropriate and a global award should be made. The court set aside the lower court's award for loss of dependency and substituted it with a global sum of Kshs. 1,000,000/=. The other heads of damages were upheld, and the total award was made subject to 20% contributory negligence as previously agreed....
