The trial court erred by imposing a custodial sentence without the option of a fine where the law expressly provided for such an option. For Count I, Section 95 of the Wildlife Conservation and Management Act, 2013 prescribes a minimum sentence of a fine of not less than one million shillings or imprisonment for not less than five years, or both. The court had no discretion to impose a lesser sentence but was required to consider the option of a fine. For Count II, Section 92 prescribes a maximum sentence of a fine not less than twenty million shillings or imprisonment for life, or both, allowing the court discretion to impose a lesser sentence and to provide the option of a fine.
