Ratio Decidendi

The Court held that service of the notice of appeal and related documents on Mr. Kimani Muhoro, who had conduct of the applicant's case with her authority and had acted as her advocate throughout the proceedings, constituted proper service under the rules. The applicant had not notified the court of any change in representation or that Mr. Muhoro had ceased to act for her. The Court found it untenable for the applicant to claim that Mr. Muhoro lacked authority to accept service, given her prior conduct and the absence of any protest from Mr. Muhoro himself. Accordingly, the application to strike out the appeal for want of proper service was dismissed.
