The Court found that an employment relationship existed between the Claimant and the Respondent, as evidenced by the employment card and salary form, which were not challenged by the Respondent. The termination of the Claimant's employment was effected on grounds of redundancy. However, the Respondent failed to comply with the mandatory procedural requirements set out in Section 40 of the Employment Act, including notice and payment of statutory dues. As a result, the redundancy was unlawful and amounted to unfair termination under Section 45 of the Act.
