Ratio Decidendi

The court found that the 1st Defendant failed to pay the full purchase price, and the 2nd Defendant did not advance the loan for which the charge was registered. The transfer and charge were registered under the Registration of Titles Act, and the registrar cannot simply remove the entries and reinstate the Plaintiff's title as demanded. However, since the 2nd Defendant is not owed any money, there is no basis for the charge to remain. The court ordered the 2nd Defendant to discharge the charge at its expense and directed the Chief Land Registrar to transfer or reconvey the Suit Property to the Plaintiff upon discharge. The claim for loss of rental income was denied due to lack of proof.
