Ratio Decidendi

The court found, on unchallenged evidence, that the defendant's permanent structure encroached approximately 3 metres by 7 metres onto the plaintiff's late mother's registered land. The defendant's own letter acknowledged the encroachment and demanded payment for demolition. The court held that the encroachment was unlawful and ordered the defendant to demolish the encroaching part of the structure within 30 days, failing which the plaintiff may do so. As the plaintiff failed to prove specific losses, only nominal general damages of KShs.1,000/- were awarded for trespass. Costs were awarded to the plaintiff.
