Procedural Posture

Civil Appeal / Application to Set Aside Dismissal and Reinstate Appeal

  1. 1 Whether the order dismissing the appeal should be set aside and the appeal reinstated.
  2. 2 Whether the delay in prosecuting the appeal was excusable.
  3. 3 Whether the appellant's counsel's absence constituted sufficient cause for non-attendance.

Ratio Decidendi

The court found that although there had been significant and largely unexplained delay in prosecuting the appeal, the interests of justice required that the appellant be given an opportunity to prosecute the appeal, particularly in light of the explanation for counsel's absence and the appellant's renewed eagerness to proceed. The court exercised its discretion under Section 95 of the Civil Procedure Act to extend time and reinstate the appeal, subject to the condition that the record of appeal be filed within 30 days. The appellant, though successful, was denied costs due to having occasioned the delay.

Court Disposition

Application allowed; appeal reinstated subject to conditions.

Orders
