The court found that although the District Co-operative Officer had the authority to convene a special general meeting under Rule 25(4) of the Co-operative Societies Rules, the removal of the appellants from the management committee was procedurally irregular because the required 3/4 majority of members present did not vote in favour of their removal. Only 59.8% voted for removal, falling short of the statutory threshold. Consequently, the subsequent election of new officials was null and void as it was predicated on an unlawful removal.
