The High Court held that the learned magistrate erred in law by purporting to revoke a confirmed grant of representation issued by another court, as such jurisdiction is exclusively vested in the High Court under section 76 of the Law of Succession Act. The magistrate's orders revoking the grant and ordering the re-transfer of land were therefore made without jurisdiction and must be set aside. While the evidence showed that the grant was obtained fraudulently and that the appellant was irregularly included as a purchaser, the proper procedure would have been for the parties to move the High Court for revocation of the grant.
