The High Court found that the learned magistrate erred in law by revoking a confirmed grant of representation issued in Embu Principal Magistrate’s Court Succession Cause No. 34 of 1996, as jurisdiction to revoke or annul such a grant is vested solely in the High Court under section 76 of the Law of Succession Act. The magistrate's orders for revocation and re-transfer of the land parcels were therefore made without jurisdiction and could not stand. While the court agreed that the grant was obtained fraudulently and that Jacinta Muthoni Muriithi lacked capacity to sell the land before obtaining letters of administration, the proper procedure would have been to refer the parties to the...
