Ratio Decidendi

The court found that the claimant's summary dismissal was both substantively and procedurally unfair. The respondent failed to conduct an audit or physical stocktaking to verify the alleged theft and did not accord the claimant a disciplinary hearing. The claimant, who reported the discrepancies, was dismissed hastily without justifiable reason. Under the repealed Employment Act, the only remedy available for wrongful dismissal was payment of salary in lieu of notice, not compensation for wrongful termination or salary for the period under criminal trial. The court therefore awarded the claimant one month's salary in lieu of notice, as per his contract, but dismissed the other claims.
