Ratio Decidendi

The court found that while the defendant entered the suit land in February 2010, the plaintiff only became the registered proprietor on 18th March 2013. The defendant could not have sought the plaintiff's consent prior to that date. However, from the date of registration, the plaintiff acquired absolute and indefeasible title under the Land Registration Act. The defendant, having remained on the land without the plaintiff's consent and failing to defend his occupation in court, is deemed a trespasser from the date of the plaintiff's registration. The plaintiff is entitled to vacant possession and eviction orders, but not to damages, as no basis for damages was established.
