The court held that while the law generally requires specificity when seeking scrutiny or recount of votes, the request for access to electronic information from the KIEMS Kits and SD Cards stands on a different footing. Regulation 16 of the Elections (Technology) Regulations, 2017 and section 27 of the IEBC Act, 2011, as well as Article 35 of the Constitution, entitle the petitioner to access such information unless a statutory exception applies. The respondents did not invoke any such exception.
