Ratio Decidendi

The court found that the Respondent failed to provide any evidence of a valid reason for terminating the Claimant or to demonstrate that fair procedure was followed, as required by Sections 41 and 45 of the Employment Act. The Claimant was not given notice or an opportunity to be heard, and the Respondent did not pay terminal dues or compensation for injury as assessed by the Occupational Health and Safety Office. The court concluded that the termination was both substantively and procedurally unfair. Consequently, the Claimant was entitled to compensation for injury and for unfair termination, calculated as four months' salary, in addition to costs and interest.
