Although the applicant provided reasons for the delay and had previously attended court, the application to reinstate the suit was filed by a firm of advocates (Shako & Company Advocates) not properly on record, as there was no notice of change of advocate from the previous firm (Omollo & Company Advocates). The absence of a duly filed notice of change of advocates rendered the application incompetent. Consequently, the court could not invoke its inherent power to set aside the dismissal order and restore the matter, regardless of the merits of the applicant's explanation for the delay.
