The court noted that there had been an inadvertent misrepresentation to the effect that the application was still pending, which led to unnecessary directions for written submissions. Upon review of the record, the court confirmed the abandonment of the application and held that the prior orders for the hearing of the distribution of the estate by viva voce evidence remain in force.
