No. West Pokot/Chepareria/2312 following a valid adjudication process, which was upheld after the High Court quashed the District Commissioner's contrary decision. The defendants failed to prove any fraud in the acquisition of the title. The evidence showed that the defendants have their own registered land and no legal right to remain on the suitland. The burial of the first defendant's husband on the suitland did not confer any proprietary rights. Consequently, the defendants are trespassers and must be evicted. The counter-claim was dismissed for lack of proof.
