The Tribunal found that the landlord provided a reasonable and uncontroverted explanation for his advocate's failure to attend court and file a replying affidavit, supported by email evidence of technical difficulties. In the absence of a replying affidavit from the tenant to challenge this explanation, the Tribunal exercised its discretion to set aside the ex parte orders of June 20, 2022. The tenant's subsequent application for orders to break into the premises was dismissed as it was based on orders that had lapsed due to non-payment of rent arrears.
