Ratio Decidendi

The court found that the Association's Constitution does not vest exclusive authority in the Chairman to call special general meetings or elections; such meetings may be called by the committee or upon requisition by members. The applicant did not seek to quash the decisions of the special general meeting or the probe team, nor did he demonstrate any irregularity in the process of the elections or the registration of officials. The application for an injunction to restrain the registration of the officials elected on 29th May 2018 was therefore without merit and was dismissed with costs to the respondents.
