Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appellant was liable for the respondent's injuries sustained in the course of employment.
  2. 2 Whether the respondent contributed to his own injuries through negligence or failure to use protective gear.
  3. 3 Whether the award of general damages by the trial court was justified in light of conflicting medical evidence.

Ratio Decidendi

The court found that the appellant, as employer, owed the respondent a duty of care and failed to provide adequate protective gear, resulting in the respondent's injury. Despite conflicting medical reports regarding the extent of injury, the court determined that the respondent was indeed injured in the course of employment. However, due to the contradictions in the medical evidence, the court found it appropriate to reduce the general damages awarded by the trial court from Kshs. 320,000 to Kshs. 200,000. The court held the appellant wholly liable for the respondent's injuries and confirmed the respondent's entitlement to special damages, costs, and interest.

Court Disposition

Appeal partially allowed; award of general damages reduced.

Orders

  • General damages awarded to respondent reduced to Kshs. 200,000.
  • Special damages awarded to respondent in the sum of Kshs. 4,000.
