Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicant should be granted leave to file an appeal out of time against his conviction and sentence for robbery with violence.
  2. 2 Whether the applicant had previously complied with the law in filing his appeal but was prejudiced by an error at the registry.

Ratio Decidendi

The court found that the applicant had alleged compliance with the law in filing his appeal within time, but due to an error at the registry, the appeal could not be traced. Given the seriousness of the sentence (death penalty) and the timely filing of the present application, the court held that it was just and fair to grant the applicant another opportunity to challenge the conviction and sentence. The application for leave to appeal out of time was therefore allowed, and the applicant was ordered to file the Petition of Appeal within 14 days.
